Thursday, February 7, 2013 – 7:30 p.m.
The Howard County Delegation of the Maryland General Assembly, chaired by Delegate Guy Guzzone and Senator James Robey, will hold a public hearing for citizen input on any legislation of statewide impact being considered during the 2013 legislative session. The Delegation will also hear testimony on recently proposed local bills.
The Howard County Delegation will hear testimony on the following bills first, followed by testimony on any statewide legislation.
HO. CO. 16-13.
Howard County – Alcoholic Beverages – Farmers Markets
Submitted by the Howard County Delegation Chairs and the County Executive
FOR the purpose of authorizing the State Comptroller to issue a winery special event permit to Class 4 Maryland limited winery in Howard County for unlimited use for a certain amount of time each week at certain farmers’ markets in Howard County; and generally relating to the issuance of a winery special event permit for use at a farmers’ market in Howard County

Howard County – Alcoholic Beverages – Farm Brewery License
Submitted by Delegate Warren Miller
FOR the purpose of authorizing the Comptroller to issue in Howard County one Class 8 farm brewery license to a person that holds not more than a certain number of Class B beer, wine and liquor licenses; and generally relating to the issuance of a Class 8 farm brewery license in Howard County.

Creation of a State Debt – Howard County – Vantage House
Submitted by Senator Kasemeyer, Delegate Bobo, Delegate DeBoy, and Delegate Malone
FOR the purpose of authorizing the creation of a State Debt not to exceed $75,000, the proceeds to be used as a grant to the Board of Directors of Vantage House Retirement Community in Columbia for certain development or improvement purposes; providing for disbursement of the loan proceeds, subject to a requirement that the grantee provide and the expend a matching fund; establishing a deadline for the encumbrance or expenditure of the load proceeds; and providing generally for the issuance and sale of bonds evidencing the loan.

Creation of a State Debt – Howard County – Middle Patuxent Environmental Area
Submitted by the Howard County Delegation Chairs and the County Executive
FOR the purpose of authorizing the creation of a State Debt not to exceed $150,000, the proceeds to be used as a grant to the County Executive and County Council of Howard County for certain development or improvement purposes; providing for disbursement of the loan proceeds, subject to a requirement that the grantee provide and the expend a matching fund; establishing a deadline for the encumbrance or expenditure of the load proceeds; and providing generally for the issuance and sale of bonds evidencing the loan.

Creation of a State Debt – Howard County – The Arc’s Homewood Road Renovation

FOR the purpose of authorizing the creation of a State Debt not to exceed $100,000, the proceeds to be used as a grant to the Board of Directors of The Arc of Howard County, Inc. for certain development or improvement purposes; providing for disbursement of the loan proceeds, subject to a requirement that the grantee provide and the expend a matching fund; establishing a deadline for the encumbrance or expenditure of the load proceeds; and providing generally for the issuance and sale of bonds evidencing the loan.

Education – Howard County Library System – Collective Bargaining
Submitted by the Howard County Delegation Chairs and the County Executive
FOR the purpose of authorizing employees at the Howard County Library System to form join and participate in an employee organization and bargain collectively the representative; authorizing an employee to refuse to join or participate in the activities of an employee organization; specifying that it is not a violation of the rights of the employee for certified exclusive representative to seek enforcement of certain collective bargaining agreement provisions; specifying the collective bargaining units and the come composition of the units; requiring a third-party neutral to investigate a certain petition under certain circumstances; acquiring the third-party neutral to certify a certain employee organization as the exclusive representative under certain circumstances; requiring the third-party neutral to conduct a certain election under certain circumstances; requiring that the library system and the employee organization or certified exclusive representative share equally certain costs; requiring the library system to recognize certain rights of the certified exclusive are presented; requiring the library system and the certified exclusive representative to enter into a collective bargaining agreement that contains provisions regarding certain matters; authorizing the certified exclusive representative to charge a certain service fee; prohibiting certain grievance procedures from allowing an arbitrator to alter the terms of the collective bargaining agreement; requiring that certain grievance procedures be the only procedures for the employees in the unit; providing that the terms of the collective bargaining agreement supersede any conflicting regulation or administrative policy of the library system; specifying want to collective bargaining agreement is effective and when it expires; providing for procedures for mediation and binding arbitration regarding collective bargaining negotiations; requiring the library system to submit certain terms of the collective bargaining agreement to the Board of Library Trustees for Howard County for its acceptance or rejection; requiring the board to take certain action regarding the terms submitted to it for review; requiring the library system and the certified exclusive representative to take certain action if the board rejects a term; providing that a collective bargaining agreement may not compare certain rights and responsibilities of the library system; prohibiting the library system and an employee organization from taking certain actions regarding collective bargaining; prohibiting an employee or an employee organization from engaging in, including, initiating or ratifying a strike; authorizing a court of competent jurisdiction to enjoying a strike under certain circumstances; prohibiting an employee from receiving compensation from the library system under certain circumstances; authorizing a third-party neutral to take certain action against an employee or an employee organization for violating a certain provision of this act; providing that this act and a collective bargaining agreement entered into under this act supersedes certain provisions of law; requiring the library system to retain make available to the public certain decisions issued by third-party neutral; defining certain terms; and generally relating to collective bargaining for employees of the Howard County Library System.

FOR the purpose of authorizing the creation of a State Debt not to exceed $200,000, the proceeds to be used as a grant to the Board of Directors of the Domestic Violence Center of Howard County, Inc. for certain development or improvement purposes; providing for disbursement of the loan proceeds, subject to a requirement that the grantee provide and the expend a matching fund; establishing a deadline for the encumbrance or expenditure of the load proceeds; and providing generally for the issuance and sale of bonds evidencing the loan.

Howard County – Deer Hunting on Private Property - Sundays

FOR the purpose of authorizing a person in Howard County to hunt deer on certain Sundays on private property using certain hunting equipment during certain months; removing Howard County from the list of counties in which deer hunting on private property on certain Sundays is prohibited; and generally relating to deer hunting on private property in Howard County on Sundays.

Howard County - Casino Events - Authorized
Submitted by W. Miller and Malone
FOR the purpose of authorizing certain organizations to hold certain casino events in Howard County at certain intervals of time; requiring an organization to obtain a permit from the Howard County Department of Inspections; Licenses, and Permits before operating a casino event; requiring the Howard County Executive to forward a recommendation to the Howard County Council concerning the fee to be charged for a permit; requiring the County Council to adopt by resolution the amount of the permit fee; specifying the types of organizations eligible to conduct a casino event; requiring a permit holder for a casino event to ensure that certain standards are met; prohibiting a permit holder from offering cumulative money prizes in excess of a certain amount specifying certain prohibited acts and reporting requirements for a permit holder for a casino event; requiring the Department to adopt certain regulations governing casino events; altering in Howard County the application of certain general provisions of law governing gaming in the State; establishing certain exception to prohibitions against conducting a casino event or operating or awarding prizes using certain gaming devices; defining a certain term; and generally relating to casino events in Howard County.

Howard County – Noise Control - Exception

FOR the purpose of prohibiting the Department of the Environment, Howard County, or a political subdivision of Howard County from adopting any sound level limit or noise control ordinances, rule, or regulation that prohibits the electronic amplification of sound between certain hours at an outdoor concert venue with a certain capacity in Howard County; and generally relating to the adoption of sound level limits and noise control ordinances, rules, regulations that prohibit the electronic amplification of sound in Howard County

Howard County –Alcoholic Beverages – Continuing Care retirement Community Living
Submitted by the Howard County Delegation Chairs
FOR the purpose of establishing in Howard County a Class C (Continuing Care Retirement Community) beer, wine and liquor license; establishing qualifications for a licensee; authorizing a licensee to keep for sale and sell at retail to a resident or a guest of the community beer, wine, and liquor for consumption on the premises; providing for a annual license fee; and generally relating to alcoholic beverages in Howard County.

Howard County – Property Tax Credit – Renovated, Upgraded, or Rehabilitated Property

FOR the purpose of authorizing the governing body of Howard County to provide a property tax credit against the county property tax for certain real property that is renovated, upgraded, or rehabilitated; authorizing the governing body of Howard County to provide, by law, for certain other criteria for the property tax credit; providing for the application of this Act; and generally relating to a county property tax credit for real property in Howard County.

Howard County – Orphans’ Court Judges - Salary

FOR the purpose of altering the salaries of each judge of the Orphans’ Court for Howard County and the annual salary of the Chief Judge for the Orphans’ Court of Howard County.

Howard County – Sheriff - Salary Increase
Submitted by the Howard County Delegation Chairs
FOR the purpose of establishing that if the salary of the lieutenants in the Howard County Police Department is increased, the annual salary of the Sheriff of Howard County shall be increased by the same dollar amount as the salary increase of the police lieutenants; providing that this Act does not apply to the salary or compensation of the incumbent Sheriff during a certain term of office; and generally relating to the salary of the Sheriff of Howard County.

Howard County – Alcoholic Beverages – Liquor Board Distance Discretion
Submitted by Delegate Guzzone
FOR the purpose of modifying a certain provision of law in Howard County so as to authorize the issuance of a certain alcoholic beverages license for a restaurant located a certain distance from a public school building, if the Board of License Commissioners approves; making a stylistic change; and generally relating to alcoholic beverages in Howard County.

Howard County – Alcoholic Beverages – Refillable Wine Containers
Submitted by the Howard County Delegation Chairs
FOR the purpose of expanding a certain application of law in Howard County to allow certain license holders to sell wine in refillable containers of a certain capacity off the licensed premises; authorizing the Board of License Commissioners to issue a refillable wine container permit; making certain requirements relating to refillable containers, advertising, posting of notice, public hearings, hours of sale, and the refilling of containers applicable to refillable wine containers and holders of refillable wine container permits issued under this Act; making a technical correction; and generally relating to alcoholic beverages in Howard County.
